"Any dispute, controversy, or claim arising out of or relating to this contract, including the performance, quality, warranty compliance, or breach thereof, which cannot be resolved through standard customer service protocols, shall be settled by binding arbitration administered by Continuity Solutions LLC in accordance with its Fast-Track Construction Arbitration Rules. The parties expressly agree that the arbitrator’s decision shall be final, binding, and enforceable in any court of competent jurisdiction within the State of Indiana. The parties further agree to equally split all upfront administrative filing fees and estimated arbitrator expenses, which shall be billed in accordance with the Continuity Solutions Standard Fee Schedule in effect at the time the claim is initiated, as a mandatory prerequisite to initiating the review process."
